Terms of Service

Terms and conditions governing access to and use of the CrewManning Platform by seafarers, ship owners, and crewing agents.

1. About the Platform

The CrewManning Platform (“Platform”) is a digital maritime crew management system operated by All Freight Support Services Ltd (RC 241763), incorporated in Nigeria under the Companies and Allied Matters Act (CAMA 2020) (“we”, “our”, “Company”). The Platform connects seafarers with ship owners and crewing agents for the purpose of crew placement, contract management, and certification administration.

By registering or accessing the Platform, you (“User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.

2. Eligibility & Registration

  • You must be at least 18 years of age to register on the Platform
  • You must have the legal capacity to enter into binding agreements under Nigerian law
  • Ship owners and crewing agents must be duly registered entities under CAMA 2020
  • Seafarers must hold valid and current maritime certifications appropriate to their declared rank and role
  • You are responsible for ensuring that all information provided during registration is accurate, complete, and kept up to date
  • You may not create more than one account. Multiple accounts created to circumvent restrictions may be permanently suspended

3. Seafarer Terms

As a seafarer using the Platform, you agree to:

  • Provide accurate and authentic information in your profile, including your rank, sea service record, and employment history
  • Upload only genuine, unaltered, and currently valid certificates, documents, and credentials. Submitting fraudulent, expired, or falsified documents is a serious breach of these Terms and may be reported to NIMASA and other relevant authorities
  • Promptly update your profile when any certificate expires, is revoked, or your circumstances change materially
  • Attend interviews and respond to messages from agents in a timely and professional manner
  • Not engage in any conduct that misrepresents your qualifications, experience, or identity
  • Comply with the terms of any employment contract entered into through the Platform
  • Not contact ship owners or agents outside the Platform to circumvent agreed placements without notifying the Company

4. Ship Owner & Agent Terms

As a ship owner or crewing agent, you agree to:

  • Provide accurate and complete company information, vessel details, and crewing requirements
  • Post only genuine vacancies for real positions and ensure all job descriptions are accurate and compliant with applicable labour and maritime laws
  • Treat all seafarers fairly and without unlawful discrimination in accordance with the Maritime Labour Convention (MLC 2006) and applicable Nigerian employment law
  • Not contact seafarers outside the Platform in ways that circumvent the placement process or deny the Company its facilitation role
  • Honour all contracts, agreements, and commitments entered into with seafarers through the Platform
  • Ensure that all vessels you recruit for comply with applicable NIMASA, ISM Code, STCW, and MLC safety and welfare standards
  • Pay all applicable platform fees and commissions in accordance with the agreed fee structure

5. Platform Role & Limitation of Liability

The Company acts as a digital facilitator connecting seafarers and ship owners/agents. We are not a party to any employment or crewing contract entered into between seafarers and ship owners or agents. We do not guarantee the availability of employment, the suitability of any seafarer, or the compliance of any vessel or operator.

While we verify documents on a best-efforts basis, we do not warrant the authenticity or ongoing validity of any certificate or document uploaded by Users. Ship owners and agents are solely responsible for independently verifying seafarer credentials before deployment.

To the maximum extent permitted by Nigerian law, the Company shall not be liable for any direct, indirect, incidental, or consequential loss arising from reliance on Platform content, employment outcomes, or the conduct of any User. Our aggregate liability shall not exceed the fees paid by the relevant User in connection with the specific matter giving rise to the claim.

6. Prohibited Conduct

Users must not:

  • Upload false, fraudulent, forged, or expired documents
  • Misrepresent qualifications, rank, sea service, or identity
  • Use the Platform for any unlawful purpose including human trafficking, forced labour, or sanctions evasion
  • Harass, threaten, or discriminate against other users
  • Attempt to reverse-engineer, scrape, or interfere with Platform systems
  • Create accounts on behalf of others without proper authorisation
  • Collect or misuse other users’ personal data accessed through the Platform
  • Engage in any conduct prohibited by NIMASA, NPA, MLC 2006, or applicable Nigerian law

Breach of this clause may result in immediate account suspension, termination, and reporting to relevant authorities.

7. Intellectual Property

All intellectual property in the Platform, including software, design, content, and branding, is owned by or licensed to All Freight Support Services Ltd. You receive a limited, non-transferable licence to use the Platform for its intended purposes. You may not copy, modify, distribute, or create derivative works from any Platform content without prior written consent.

You retain ownership of documents and data you upload. By uploading them, you grant the Company a limited licence to process, store, and share such data as described in our Privacy Policy.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account, without prior notice, where:

  • You breach any of these Terms
  • Fraudulent, false, or misleading information is detected
  • Your conduct creates legal, regulatory, or reputational risk to the Company or other Users
  • Required by a regulatory authority or court order

Upon termination, your access ceases immediately. Data retention obligations under our Privacy Policy continue to apply.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or use of the Platform shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act of Nigeria. The arbitrator’s decision shall be final and enforceable in any competent court.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Platform after the effective date of any changes constitutes acceptance. If you do not agree to updated Terms, you must discontinue use.
